Terms of Use

These Terms of Use ("Terms") govern access to and use of the Lex Ocorrências service ("Service"), operated by Lex Ocorrências ("we", "our", "us"). By using the Service, you accept these Terms.
1. The Service
Lex Ocorrências is a platform that allows residential condominium administrations ("Administrator") to receive, triage, update, and resolve occurrences (service requests, complaints, notices) submitted by residents ("Resident"), with communication delivered primarily via WhatsApp.
2. Eligibility
- Administrators must be 18 years or older and authorized to act on behalf of the condominium they register.
- Residents use the Service under their condominium's registration; they do not need to create accounts.
- The Service is not directed to minors and is not intended for use by anyone under 18 as an Administrator.
3. Account and Accuracy
Administrators are responsible for the accuracy of the information they register, including the list of resident contacts, and for keeping credentials secure. Each Administrator account is for the use of a single natural person; credentials must not be shared.
4. Administrator Responsibility for Resident Contact Lists
When an Administrator provides a Resident's WhatsApp number to the Service, the Administrator represents and warrants that:
- the Resident has provided valid consent to receive messages about occurrences from the condominium administration, or
- the Administrator has another lawful basis under applicable data protection law (LGPD, Lei nº 13.709/2018) to communicate with the Resident for the purposes of condominium management.
The Administrator remains the data controller for resident contact data; Lex Ocorrências acts as data processor, as described in the Privacy Policy. The Administrator is responsible for responding to resident rights requests and for complying with WhatsApp Business Platform policies, including not sending promotional content.
5. Acceptable Use
When using the Service, you agree not to:
- send unsolicited promotional content, spam, or marketing;
- send unlawful, defamatory, harassing, or misleading content;
- impersonate any person or misrepresent your affiliation with a condominium;
- interfere with, probe, or attempt to disrupt the Service or its infrastructure;
- circumvent opt-out mechanisms or continue sending messages to Residents who have opted out;
- use the Service in ways that violate the WhatsApp Business Messaging Policy or Meta Platform policies.
6. Content Submitted by Residents
Residents retain ownership of the content they submit (occurrence descriptions, photos, comments). By submitting content, the Resident grants the Administrator and Lex Ocorrências a limited license to store, display, and process that content solely to operate the Service and fulfill the Resident's request.
7. WhatsApp and Third-Party Platforms
Messages are delivered through WhatsApp, operated by Meta. Use of WhatsApp is subject to Meta's own terms. The Service delivers only transactional, utility messages strictly related to the occurrences opened by or addressed to each Resident; no marketing messages are sent. Every outbound message includes a link or a keyword instruction that allows the Resident to opt out at any time.
8. Service Availability
The Service is provided on an "as is" basis. We aim for high availability but do not guarantee uninterrupted operation. Planned maintenance is performed with reasonable notice when feasible.
9. Fees
Fees are agreed in writing between Lex Ocorrências and each Administrator before the Service is activated. Changes to ongoing pricing will be communicated in writing at least 30 days before taking effect for existing Administrators.
10. Termination
Administrators may stop using the Service at any time by requesting deletion of their account. We may suspend or terminate access if we reasonably believe that an Administrator has violated these Terms, applicable law, or WhatsApp/Meta policies. On termination, data is handled according to the retention rules described in the Privacy Policy.
11. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, Lex Ocorrências is not liable for indirect, incidental, or consequential damages arising from the use of the Service, including loss of profit or data, when it has acted in good faith. Nothing in these Terms limits liability where such limitation is prohibited by law, in particular under the Brazilian Consumer Protection Code (CDC) where applicable.
12. Changes to these Terms
We may update these Terms to reflect changes to the Service or to applicable law. Material changes will be communicated to registered Administrators by WhatsApp or email at least 15 days in advance. The "Last updated" date at the top always reflects the current version.
13. Governing Law
These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be resolved by the courts of the Administrator's place of business, except where the Consumer Protection Code (CDC) mandates a different forum.
